Charted Technologies Limited ("Charted Technologies", "we", "us", "our"), trading as Charted Fitness, operates the Charted Fitness application and website at chartedfitness.com (the "Service"), based in Ireland. You can contact us at support@chartedfitness.com.
Charted Technologies Limited is registered in Ireland under company number 828810.
By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are entering into these Terms on behalf of another person or entity, you represent that you have the authority to bind them. If you do not agree, do not use the Service.
You must be at least 16 years old to use Charted Fitness. By using the Service, you confirm that: you meet this age requirement; the information you provide during signup is accurate; you have the legal capacity to enter a binding contract; and, if you subscribe, you are authorised to use the payment method provided.
If you are pregnant, breastfeeding, have a history of an eating disorder, or manage a health condition, please read the health disclaimer below carefully and consult a doctor before using calorie or macronutrient targets from this Service.
Charted Fitness estimates calorie and macronutrient targets using standard published formulas (e.g. Mifflin-St Jeor), tracks food you log, and provides progress feedback and meal-composition suggestions based on the data you enter. Nutrition data for packaged foods is sourced in part from Open Food Facts, a crowd-sourced, community-maintained database — figures may be incomplete, manufacturer-declared rather than lab-verified, or occasionally inaccurate. Every subscription includes the full Service — barcode scanning, retailer filters, the micronutrient panel, adaptive coaching, and meal-composition suggestions — with no separate feature tiers, as described on our pricing page.
Charted Fitness is a wellness and nutrition-tracking tool, not a medical device. It is not intended to diagnose, treat, cure, or prevent any disease, and nothing in the Service constitutes medical advice, diagnosis, or treatment.
Calorie and macronutrient estimates are generated from general formulas and the information you provide; they are not a substitute for individualised guidance from a doctor, registered dietitian, or other qualified health professional. You should consult a healthcare professional before starting a calorie-restricted or calorie-surplus diet, particularly if you are pregnant, breastfeeding, under 18, have or have had an eating disorder, or manage a medical condition. You are solely responsible for decisions you make about your diet and health, including any decision to follow or disregard targets or suggestions shown in the Service.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account, including activity by anyone you share credentials with. Notify us immediately at support@chartedfitness.com if you suspect unauthorised access. We are not liable for any loss arising from unauthorised use of your account that occurs before you notify us.
Charted Fitness is offered as a single subscription plan, billed monthly, every 3 months, every 6 months, or annually as you choose, in euro, via our payment processor Stripe. Card details are handled entirely by Stripe and never touch our servers.
Subscriptions renew automatically each billing period at the then-current price for your chosen billing interval, until you cancel. By subscribing, you authorise us (via Stripe) to charge your payment method on a recurring basis. If a payment fails, we may retry it and may suspend access to paid features until it succeeds, as described in Section 10.
Founding Member pricing: a discounted monthly rate, limited to a capped number of spots, is reserved for new signups during a published promotional window. Where a spot is reserved and then actually used to subscribe, this discounted rate is locked in for as long as you remain continuously subscribed; lapsing and re-subscribing afterward applies then-current standard pricing.
We may issue discount codes (including group-signup codes) from time to time. Codes are subject to the terms stated when issued, may have expiry dates or usage limits, have no cash value, cannot be combined unless explicitly stated, and may be withdrawn or invalidated if we reasonably suspect abuse (e.g. a "group" code used by a single individual across multiple accounts).
If you give us your email address to sign up for our newsletter, we'll use it to send you occasional emails about new features, tips, and offers. Signing up for the newsletter is separate from having a Charted Fitness account — you can do either without the other, and subscribing does not create an account or any obligation to subscribe to the Service. You can unsubscribe at any time using the link in any newsletter email, or by contacting support@chartedfitness.com. See our Privacy Policy for how we handle the email address itself.
You may cancel your subscription at any time from the "Manage" billing portal inside the app. Cancellation takes effect at the end of your current billing period — you keep access until then, and we do not provide partial refunds for the unused portion of a billing period, except where required by law.
If a payment fails and is not resolved, we may downgrade or suspend access to paid features after a reasonable retry period.
EU/EEA consumers — right of withdrawal: under the EU Consumer Rights Directive, you would ordinarily have 14 days to withdraw from an online purchase without giving a reason. Because Charted Fitness is digital content/a digital service delivered immediately, by subscribing and beginning to use a paid tier you expressly request immediate performance and acknowledge that you lose this 14-day withdrawal right once the Service has been provided to you, in accordance with Article 16(m) of Directive 2011/83/EU. This does not affect any other statutory consumer rights you may have.
We may change subscription pricing for future billing periods. If we increase the price of your tier, we will give you reasonable advance notice (at least 30 days) by email or in-app notice before the change takes effect; continuing to use the Service after that date constitutes acceptance of the new price. You may cancel before the change takes effect if you do not agree.
You retain ownership of the data you enter (food logs, weigh-ins, goals, custom foods, and similar "Your Content"). You grant us a worldwide, non-exclusive licence to host, store, process, and display Your Content solely to operate and improve the Service for you, as described in our Privacy Policy. You are responsible for Your Content and confirm you have the right to submit it.
If you send us feedback, feature suggestions, or ideas (including via any referral or promotional programme), you grant us a perpetual, irrevocable, royalty-free licence to use that feedback for any purpose, including improving the Service, without any obligation to compensate or credit you.
The Service — including its software, design, calculation logic, meal-suggestion algorithms, branding, and content we author (excluding Your Content and third-party data such as Open Food Facts) — is owned by Charted Technologies (trading as Charted Fitness) and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal, non-commercial use, subject to these Terms.
You agree not to: copy, modify, or create derivative works of the Service; reverse-engineer or decompile any part of the Service except where applicable law permits; resell, sublicense, or provide the Service to third parties as your own; or remove any proprietary notices.
You agree not to: misuse the Service to harm others; attempt to bypass rate limits, security controls, or access other users' data or accounts; scrape or resell data obtained through the Service in bulk; interfere with or disrupt the Service's infrastructure; misuse promotional or referral mechanisms; or use the Service in a way that violates applicable law.
The Service relies on third-party infrastructure and data providers, including Supabase (authentication and data storage), Stripe (payment processing), Google (optional sign-in), Vercel (hosting), and Open Food Facts (nutrition data, licensed under the Open Database License). Availability and accuracy of these third-party services are outside our control, and their own terms and privacy policies may apply to your use of them.
We may add, change, or remove features, including features tied to a specific subscription tier, at any time. We will use reasonable efforts to notify you of material changes that reduce functionality you are actively paying for. We do not guarantee the Service will be available at all times or free of errors.
You may stop using the Service and delete your account at any time from within the app or by contacting support@chartedfitness.com; this also cancels any active subscription. We may suspend or terminate accounts that violate these Terms, with notice where reasonably practicable. Sections of these Terms that by their nature should survive termination (including Sections 12, 13, 18, 19, and 21) will survive, since disputes can still arise after your account is gone.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including accuracy, reliability, or fitness for a particular purpose. To the fullest extent permitted by Irish law, Charted Technologies' total liability to you for any claim arising from the Service will not exceed the amount you paid us in the 12 months before the claim arose, and we will not be liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under Irish consumer protection law.
You agree to indemnify and hold Charted Technologies harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Service, your breach of these Terms, or Your Content, except to the extent caused by our own breach or negligence.
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including outages of third-party providers listed in Section 15, natural disasters, or governmental action.
These Terms are governed by the laws of Ireland. If you are an EU consumer, you may also rely on any mandatory protections of your own country of residence. Disputes are subject to the exclusive jurisdiction of the Irish courts, without prejudice to your right as a consumer to bring proceedings in your own country of residence where EU law entitles you to do so.
The European Commission provides an Online Dispute Resolution platform for EU consumers at ec.europa.eu/consumers/odr, which you may use to raise a complaint. We are not obliged to participate in ODR proceedings but you are free to raise a complaint there.
UK users: if you are in the United Kingdom, you are not an "EU consumer" for the purposes of this section following the UK's withdrawal from the EU, and the EU-specific protections and the ODR platform above do not apply to you. You may instead have rights under the UK Consumer Rights Act 2015 and other applicable UK consumer protection law, which this section does not limit.
Severability: if any provision of these Terms is found unenforceable, the remaining provisions continue in full force. Assignment: you may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets, provided your rights under these Terms are not materially diminished. Waiver: our failure to enforce a provision is not a waiver of it. Entire agreement: these Terms, together with our Privacy Policy, form the entire agreement between you and us regarding the Service, superseding any prior agreements on the subject.
We may update these Terms from time to time. Material changes will be notified via the Service or by email at least 14 days before they take effect where reasonably practicable; continued use after that date constitutes acceptance.
Routine support questions should go to support@chartedfitness.com. Formal legal notices to us under these Terms should be sent to the same address with "Legal Notice" in the subject line — we will confirm receipt.
